How to Vet Rental Applications Thoroughly to Protect Yourself from Liability!


Processing and vetting rental applications is one of, if not THE, most important activities and responsibilities a rental agent has!


If you do NOT do a thorough check on applications, and something goes wrong – AND are able to prove that you did! - you MAY be held liable for any losses that a landlord may suffer as a result of your ‘negligence’ . . .

Don’t believe it? Take a look at your mandate – most mandates include the following clause, or something similar . . .


In the event that the Tenant has been correctly screened and placed by the Agent in terms of this Mandate Agreement, the Agent cannot be held liable to the Landlord for any loss or damages including the Tenant not paying Rental or vacating the Premises before the Lease Agreement expires.

In the event that the Tenant has NOT been correctly screened and placed by the Agent in terms of this Mandate Agreement, the Agent cannot MAY be held liable to the Landlord for any loss or damages including the Tenant not paying Rental or vacating the Premises before the Lease Agreement expires.


Do you have a robust rental application processing procedure that you follow? Is it documented? Do you have documentary proof that you can produce if the landlord alleges that you did not conduct due diligence correctly? Or are you at risk of being held liable for loss of rent or the tenant vacating the premises early simply because you did not do ALL due diligence required – and/or are not able to prove it in the even of a claim?
